1. What is the difference between probation and parole?

The Adult Parole Authority (APA) is responsible for the supervision of adult felony inmates after release from prison.

If you are granted probation, the court allows you to stay in the community and report to a probation officer in lieu of prison.

Yes, the Adult Probation Department respects the wish for any caller/reporter to remain anonymous. Any tips or information regarding an offender who you believe to be in violation of their court ordered conditions will be noted and relayed to the appropriate officer.

1. What is Veteran's Treatment Court?

Veterans Treatment Court is a voluntary program that is designed to assist veterans involved in the criminal justice system and address issues that led to their contact with the court. Veterans Treatment Court is court­ supervised which means that you will have regular court appearances before a designated Judge who will supervise your progress in the program.

2. How do I know if I qualify?

You are eligible for Veterans Treatment Court if you have been placed on Community Control Sanctions (CCS) or Intervention in Lieu of Conviction (ILC), you have received an Honorable or General (Under Honorable Conditions) Discharge from the United States Military Services, and drug/alcohol use, PTSD, traumatic brain injury,  or  other physical/mental condition was a significant factor in the commission of the offense. The Veterans Treatment Court Docket Judge has final discretion to decide admission into the program in accordance with the written eligibility criteria. The written legal and clinical eligibility criteria do not create a right to enter the specialized docket, but rather, provide guidelines for the discretion of the Judge.

1. The county warrant states that it must be presented within 60-days to receive payment. What if the warrant is more than 60-days old?

If you try to deposit or cash a warrant older than 60-days, it may not be honored when presented for redemption. Stale-dated warrants are paid periodically into unclaimed funds. To find out if a specific warrant can be presented for payment, or if it has become stale-dated, call (937) 562-5076.

2. How can I have a lost check reissued?

Before each election we place information on our web site estimating the cost of the levy for every $100,000 of appraised value. The cost estimate is based on residential property that qualifies for the non-business and/or owner-occupancy credit. We also estimate the total revenue to be generated from the proposed levy.

4. How do I qualify for the owner-occupancy credit property tax rollback?

The 2.5% owner-occupied credit is a real estate tax reduction available to the homeowner's principal residence. Rental properties are not eligible for the reduction. To apply for the program, you may complete the application and return it to the Greene County Auditor's Office.

5. What is the 'tax lien' date?

The tax lien date is used to reflect real estate market value each year. In Ohio, the annual tax lien date is January 1, and property taxes are always paid a year in arrears. For example, taxes paid in 2014 are for Tax Year 2013 and were calculated based on the property's value as of January 1, 2013.

6. How are my manufactured (or mobile) home taxes calculated?

If the manufactured (or mobile) home was purchased prior to January 1, 2000, the owner has the option to use the depreciation method or elect to use the appraisal method. If the the manufactured (or mobile) home was purchased after January 1, 2000, the property is taxed using the appraisal method.

1. How does the county determine property value?

The county appraises property utilizing mass appraisal methods. Data is gathered on each property and a table is developed to determine value. The accuracy of the tables are tested by looking at actual sales to determine table adjustment.

2. How often are property values updated?

A trienniel property value appraisal occurs every three years. During the trienniel process, the appraisal is conducted through software and does not include a visual appraisal. The software compares values of sold homes by geographic area. On the sixth year, the state requires a revaluation of all real property. The county is required to visually inspect each property to determine the real property value. Greene County completed the 2014 revaluation and is concluding Board of Revision hearings. The next revaluation will be conducted in 2020.

3. What can I do to ensure my value is correct?

The revaluation is significantly impacted by real estate sales in a particular area. It is important for property owners to check their property data to ensure the information the county has is correct. Also, you can look at what sales of similar homes in your area are to help determine if your value is correct.

4. I think the auditor's appraisal value is too high for my property. What are my options?

The appraised value set by the auditor's office is an important part of the property tax calculation. If you feel the appraised value is too high, a complaint can be filed with the Greene County Board of Revision. Board of Revision complaints must be filed between January 1 and March 31.

5. There are several foreclosure sales in my neighborhood, what is the impact on my property value?

The State of Ohio does not allow our office to use foreclosure sales in our analysis because they are not considered arms-length sales.

6. If my property value is decreased, does that mean I will see a reduction on my taxes?

There is no dollar-for-dollar correlation between the decrease/increase in appraised value and taxes. Your appraised value multiplied by the voted levies equal your generated taxes. Most tax rates are adjusted each year to ensure they generate the amount of revenue they generated in the previous year.

1. How can I file a BOR complaint form?

Complaint forms are available in the Document Center and can be filed by mail, email, or delivered to the auditor's office. If the complaint has been scanned, please contact us and a county representative will provide an email address to send as an attached document.

2. When can I file a BOR complaint?

Complaints can be filed through March 31st of each year (the date is extended to the next business day if the 31st falls on a weekend). If a complaint is filed by mail or certified mail, and has a United States postmark (on the envelope or sender's receipt) of March 31st, it will be considered filed on March 31st. A private meter postmark on an envelope is not a valid postmark for purposes of establishing the filing date.

3. What tax year can I file for?

Complaints are limited to the current tax year for which taxes are due, which is always for the previous year. For example, taxes due in 2014 are for tax year 2013.

4. If I am filing on a recent purchase or sale of property, what documents should I submit with my complaint?

The number of days the property was on the market, a copy of the closing statement, and the listing price for the property are all useful documentation. The information should be available from the realtor.

5. What should I expect once I have filed my complaint?

6. If I get a reduction in value, how do I get a refund or credit?

Once the Board of Revision has made a decision, the Auditor will adjust the record and a refund or credit will be issued. The refund process can take up to a month depending on the number of complaints.

7. What if I do not agree with the Board of Revision decision?

An appeal of the Board of Revision decision begins with filing the proper notice of appeal form with with the Ohio Board of Appeals or with the Court of Common Pleas. The appeal must be filed within 30-days of the date on the Board of Revision decision letter.

8. Does a Board of Revision value decision carry forward?

The decision is with the discretion of the Board of Revision. In many cases, the decision will carry forward until the next valuation update.

9. Do I need an attorney to file for a Board of Revision complaint?

There is no requirement that an attorney represent the claim before the Board of Revision. An individual always has the right to represent themselves for the complaint. In the case of a corporation, there are restrictions as to who can file the complaint and offer evidence on the value of the property.

1. What is the Current Agricultural Use Value Program?

The Current Agricultural Use Value Program was implemented within the State of Ohio to save open spaces and to permit the valuing of farmland on its ability to produce income rather than on market value. The CAUV law can provide significant tax savings benefits to those involved in agricultural production if qualifications are met.

2. What are the eligibility requirements?

Any tract of agricultural land of 10 acres or more which has been in agricultural use for the last three (3) years is eligible. A smaller tract may by included in this program if the tract produced an average income of $2,500 or more from sales of agricultural products during the previous years or if there is an expected gross income of that amount.

The land must be devoted exclusively to agricultural use.

The county auditor is required to review each parcel in CAUV to see if it meets the requirements. If it does not, the auditor is required by the Ohio Revised Code to remove the property and recoup the taxes.

3. How many acres are required to qualify for the Current Agricultural Use Valuation program?

You need more than ten acres which must be used exclusively for agricultural purposes. Farms of ten acres or less of qualifying land must report their yearly gross income and must maintain an average yearly gross income of $2,500 to continue to qualify for the program.

4. For what length of time is the application effective?

The CAUV application must be filed each year. The county has devised a simplified renewal procedure requiring only a notification from year to year.

5. Do you have to own a farm for three years before you can apply?

No. The farm has to qualify, not the owner.

6. What happens if I do not re-file my CAUV Application?

If you do not re-file your application for a Current Agricultural Use Valuation, the auditor is required to value the property at its true market or current market value to recoup the taxes for the current tax year and for three (3) years in the past.

7. How does the Current Agricultural Use Value valuation differ from fair market value?

The fair market value normally depends upon establishing the value for the farm land based on comparing it to recent sales of similarly situated farms. The CAUV system depends upon capitalizing the expected net income received from farming.

1. What is the homestead exemption?

The homestead exemption allows senior citizens and permanently and totally disabled Ohioans to reduce their property tax burden by shielding some of the market value of their home from taxation.

The exemption, which takes the form of a credit on property tax bills, allows qualifying homeowners to exempt $25,000 of the market value of their home from all local property taxes. For example, through the Homestead Exemption, a home with a market value of $100,000 would be billed as if it is worth $75,000.

2. What is the deadline to apply?

Application must be filed by December 31 of year for which you are applying.  If you are applying for tax year 2018 for taxes due in calendar year 2019 the application must be filed by December 31, 2018 or a late application can be filed prior to December 31, 2019.

3. How has the homestead exemption changed?

Beginning January 1, 2014, the homestead exemption will have a means test. In order to qualify your household annual adjusted gross income cannot exceed $30,000 for property owners over 65 or permanently and totally disabled.

4. Who qualifies for the new homestead exemption?

Any Ohio resident homeowner who:

Is at least 65 years old or turns 65 in the application year; or

Is totally and permanently disabled as of January 1st of the application year, as certified by a licensed physician or psychologist, or a state or federal agency; or

Is the surviving spouse of a person who was receiving the previous homestead exemption at the time of death and where the surviving spouse was at least 59 years old on the date of the death.

The annual household adjusted gross income must be less than $30,000.

To qualify, an Ohio resident also must own and occupy a home as their principal place of residence as of January 1st of the application year, for real property or manufactured home property. For individuals who own more than one home, the principal place of residence is the home where the person is registered to vote and the person's place of residence for income tax purposes.

5. When will the reduction affect my property taxes?

The reduction will be reflected on the tax bill that is die the year following the year you originally apply.

For example, assume you turn 65 in November 2014, the homestead application would need to be filed by the first Monday in June and the reduction would appear on the tax bill you receive in 2015.

6. How will I know if my application has been approved?

If the county auditor approved your application, the county treasurer notifies by enclosing a notice showing the calculation of your tax reduction with the first tax bill you receive for payment the following year.

If the county auditor denied your application, you were required to receive a notice on or before November 1st informing you of and explaining the reason for denial.

7. May I file electronically?

Not at this time. A paper copy of the application bearing your original signature must be filed with the county auditor of the county in which your home is located.

8. Will I have to apply every year to receive the homestead exemption?

No. In January each year the county auditor will mail a copy of the continuing application form. Please return the form (DTE 105B to the auditor only if you no longer own the home, no longer occupy it as your primary place of residence, or if your disability status has changed,

9. May I apply for the Homestead Exemption Program if I am a surviving spouse?

A surviving spouse between the ages of 59 and 64 of a person who was receiving the homestead exemption by reason of age or disability in the year of the death may continue to receive the reduction as long as they continue to meet the residency guidelines.

10. May I apply for the Homestead Exemption Program if my children's names appear on the deed, too?

Yes, as long as the applicant's name appears on the deed. Life Estates and Inter Vivos Trusts are also acceptable.

11. I am 65, but my spouse is younger than I am. Are we eligible for the home exemption?

If one of the principal owners of the property is 65 (or disabled) and the home is that person's principal place of residence, the property is eligible for the Homestead Exemption. An eligible owner's surviving spouse may continue to receive the Homestead Exemption if the eligible spouse dies and the spouse is at least 59 on the date of death.

12. How do you define permanently and totally disabled?

Section 323.151(E) of the Ohio Revised Code states "'permanently and totally disabled' means a person who has impairment in body or mind that makes him unfit to work at any substantially remunerative employment which he is reasonably able to perform and which will, with reasonable probability, continue for an indefinite period of at least twelve months without any present indication of recovery there from or has been certified as permanently and totally disabled by a state or federal agency having the function of so classifying persons."

13. What documentation do I need to provide to prove my disability?

If you are claiming a physical disability, you must have the certificate on the back side of the application signed by a physician licensed to practice medicine in the State of Ohio. If you are claiming a mental disability, you must have the certificate signed by a physician or psychologist licensed to practice in Ohio. In order to qualify for the homestead exemption, an owner's disability must be permanent and total and prevent the person from working at any substantial employment. You may also submit a current certificate from any state or federal government agency that classifies you as disabled, as defined above.

14. How do I show proof of age?

The application form requires individuals to report their age and date of birth, and it is signed under penalty of perjury. The county auditor may require some evidence of age, such as a driver's license or birth certificate.

15. How do I prove my income?

You must bring a copy of your most recent tax return to the auditor's office for review.

1. What is a manufactured home?

"Manufactured home" means a building unit of assembly of closed construction fabricated in an off-site facility with a label or tag permanently affixed to it certifying compliance with all applicable federal construction and safety standards.

2. What is considered a permanent foundation?

A permanent foundation means permanent masonry, concrete, or locally approved footing or foundation, to which a manufactured or more home may be affixed.

3. What is a mobile home?

"Mobile home" is defined as a building unit of assembly of closed construction that is fabricated in an off-site facility, is ore than 35 body feet in length, or when erected on site, is 320 or more square feet, that is built on a permanent chassis and is transportable in one or more sections, and does not qualify under the act's definition of a manufactured home or industrialized unit.

4. Do I need to notify the county if I am relocating my manufactured/mobile home?

Effective March 30, 1999, any manufactured or mobile home that is moved on a public road within Ohio must have a Relocation Notice attached to the rear of the home while being moved. You can obtain a Relocation Permit from the Greene County Auditor's Office upon showing proof that all taxes have been paid. Failure to obtain a permit is a minor misdemeanor with a fine of $100.00 to the owner and the person moving the home.

5. Is there a penalty for failing to register my manufactured or mobile home?

Yes. All manufactured and mobile home owners must register their home with the county auditor within 30-days after acquiring situs in Greene County. Failure to do so will subject the owner to a $100.00 penalty.

6. How are my manufactured (or mobile) home taxes calculated?

If the manufactured (or mobile) home was purchased prior to January 1, 2000, the owner has the option to use the depreciation method or elect to use the appraisal method. If the the manufactured (or mobile) home was purchased after January 1, 2000, the property is taxed using the appraisal method.

7. If I disagree with my property valuation, how can I contest it?

Homeowners whose taxes are based on the appraised value can appeal the value of the home to the Board of Revision of any year between January 1st - March 31st. The applications are available in the auditor's office or in the Document Center.

8. Are there tax relief programs for manufactured or mobile homes?

Rollbacks: These property tax reductions that were only available to real property owners are now available to manufactured and mobile home owners. There is a non-business credit (10% rollback) for everyone and an owner-occupied credit (2.5% rollback) manufactured and mobile home owners.

House Bill 920: Passed into law in 1976, it provides a credit against all voted tax millage. As property values increase due to reappraisals additional 'credit' are applied to voted tax levies so the property owners are not paying more than the amount of taxes the levy was originally voted to collect. The only increased revenue taxing districts receive from voted levies is form the added value of new construction.

Homestead Exemption: Manufactured and mobile homeowners 65 years old or permanently disabled are eligible if the household income is $24,100 or less per year. The program reduces the taxable value of the property, thereby reducing the taxes owed. Applications are available through the auditor's office. The application may be filed between the first Monday in January and the first Monday in June each year.

9. What happens if I forgot to pay my property taxes?

On or before September 1st of every year, a lien list of all delinquent manufactured or mobile homes will be filed in the county recorder's office. The list is also advertised in local newspapers.

10. Is there interest on delinquent taxes?

Delinquent manufactured and mobile home taxes are now subject to interest.

1. What period do my property taxes cover?

Property taxes are paid one year in arrears. Taxes paid in 2014 are based on the condition of the property as of January 1, 2013.

2. Is it true that a levy can be passed in November 2013 and be on my tax bill in 2014?

Yes, a levy passed in November 2013 will be on the tax bill in 2014. When you vote on a levy, the ballot will specifically identify the tax year the levy is to start. In the case, if the levy states the tax levy will be effective for tax year 2013, then it would appear in the 2014 tax bill.

3. If my property value is decreased, does that mean I will see a reduction on my taxes?

5. What are the different types of levies?

Inside levies (Unvoted): Each taxing district can have up to 10 mills of unvoted millage. This millage moves in direct correlation with your property value. For example, if the value of your home increases 5%, the taxes on your inside millage will increase 5%. Fixed Sum Levies: Tax levies approved by voters to generate a specific amount of money. The two most popular fixed sum levies are emergency and a bond levy. In each case, the Budget Commission meets to determine the rate necessary to generate the amount of money that will comply with the levy requirements. Fixed Rate Levies: This type is the most common type of levy and must by approved by the voters. The levy only generates additional income if new construction occurs. If the value within a taxing subdivision's territory goes up due to a reappraisal, the tax rate is reduced so that it generates the same amount of money it did in the prior year. The effective rate can never be more than the voted rate. If the value increases due to new construction there will be additional tax revenue realized by the subdivision. The converse is also true.

6. Are there any tax reduction programs?

Non-business credit: All residential and agricultural property in the state automatically qualify for the non-business credit. The state pays 10% of your tax liability on your behalf.

Owner-Occupancy Credit: Residential property qualifies for this program if the property owner-occupied and the property owner does not claim any other property as their primary residence. To qualify for this program, you must file an application with the Greene County Auditor prior to the first Monday in June. Rental property does not qualify for the credit.

Homestead: If you are 65 or older or are permanently disabled you may qualify to have the taxes on the first $25,000 of your appraised value paid by the State of Ohio. Please visit the Homestead page to learn more.

7. What is the effective tax rate?

The effective tax rate is the rate at which your taxes are calculated. It is arrived at through a complex mathematical formula. The goal of the formula is to prevent changing the tax revenue generated by a political subdivision simply because the value of property has increased or decreased due to market conditions.

The thought process behind this is that when you vote on a levy, you are voting to give the political subdivision a certain amount of money. If values of real estate change due to market conditions, the taxes should not necessarily change with them. In other words, just because your property value went up 10% does not mean it costs 10% more to provide fire service to your property.

8. Can you explain a taxing division?

A taxing district is the group of political subdivisions that serve an area.

For example, taxing district B42 represents Beavercreek City, but government services are provided to the residents of Beavercreek City and tax dollars are collected for Greene County, Beavercreek Township, Beavercreek City School District, Beavercreek City, and the Greene County Career Center.

9. What value does the county use to determine my taxes?

The county auditor is required to appraise every property in the county. The value is the appraised value, or market value. Your taxes are based on an assessed value which is equal to 35% of the appraised value.

1. Do I have to get a vendor's license?

Anyone selling something in the State of Ohio needs a vendor license. There is a onetime fee of $25 for a vendor's license and there is a fine by the state if you are caught without one. A vendor's license is needed in order to pay sales tax to the state.

Examples of businesses needing a vendor's license include: dog breeding for resale purposes, continuous garage sale, retail stores, food and goods sales at the fair and many other things.

If you have questions about the need for a license, please call the auditor's office. The auditor's office only sells vendor licenses for Greene County. If you need a delivery, transient, or service license, please contact the State of Ohio. All licenses are available online at the Ohio Department of Taxation.

2. When is a vendor's license required and how do I get one?

A vendor's license is required by state law when a business conducts retail sales. Having a vendor's license enables the business owner to collect sales tax for the State of Ohio. The license is issued by the county auditor's office in the county in which the business is located. 3. What is a taxable sale?

A taxable sale includes any transaction in which title or possession of tangible personal property or certain service is, or will be, transferred or provided for a price. Unless specifically exempted in Ohio's sales tax laws, all sales and many services are subject to tax.

4. How frequently must each business file and pay sales tax?

According to the Ohio Revised Code: "...on or before the twenty-third day or each month (each person who has...a vendor's license shall...) make and file a return for the preceding month, on forms prescribed by the tax commissioner."

"The return shall be considered filed when received by the treasurer of the state... The treasurer of the state shall stamp or otherwise mark on all returns the date received... and shall also show thereon...the amount of payment received with the return."

Returns must by filed even if no sales are made and/or tax collected. If a vendor does not file a return, the Department of Taxation may revoke a license because of inactivity.

5. Do I get a discount for paying promptly?

Yes. If the return is filed and paid on or before the due date, the vendor is entitled to a discount of .0075% of the amount shown due on the return.

6. What happens if I do not pay on time?

For each return that is not paid in full with-in the time limit, $50.00, or 10%, of the required tax, whichever is greater, must be paid in addition to the unpaid tax for that reporting period.

1. What are the duties of the Weights & Measures inspectors?

Weights and Measures inspectors inspect any weighing or measuring device used in commercial transactions. Inspectors work with the general public by filing complaints concerning devices and consumer goods. The department goal is to assure equity in the marketplace for both consumers and merchants.

Fuel meters, retail devices, price verification systems, packaged goods, mulch, firewood, taxi meters, timing devices, are all examples of devices inspected and tested in the county.

2. How often are inspectors certified?

All weights and measures inspectors are required to receive training and certification from the Ohio Department of Agriculture, Division of Weights and Measures. Inspectors must pass a series of 20 tests and 2 exams, as well as attend 18 hours of continuing education class per year to maintain certification.

3. How do I report an error?

If an error is found, the facility equipment may be temporarily shut down or the operators may be fined. Records are maintained for all reported complaints. To file a complaint, please submit a form and inspectors will follow-up with the request.

4. What type of identification should be displayed on pre-packaged commodities?

All commodities must be marked with a statement declaring net contents. Net weight does not include the weight of the bag, wrapper, or container of any kind in which a commodity may be packaged. This is called the tare weight, which must be accounted for before the product is weighed Inspectors from the state and county periodically check the accuracy of these pre-packaged items.

5. What is a U.P.C. scanner?

The Universal Product Code (UPC) is used in most retail stores to scan the price of the item. The price of the item is entered into a computer. When the item is scanned, the price will immediately appear on the register. The county auditor is helping to ensure that the labeled shelf price or the advertised price matches the price appearing at the checkout.

6. How are gas pumps inspected?

Fuel is sold by volume in gallons or liters. A computer in the gasoline pump calculates what you owe based on the amount and unit price of the gasoline. Weights and measures officials post a seal to show the equipment was tested and found to be accurate.

7. How is fire wood labeled?

In Ohio, the legal method of sale for fire wood is the cord of a cord. A "cord" is defined as 128 cubic feet. Fire wood must be labeled in cubic feet or cubic inches.

1. Does my dog need a license?

Yes, it is the law! A dog is required to be licensed once it is 3-months of age or thirty days from the date the dog is acquired or brought from out-of-state. If the dog has a license from another Ohio county, the license is good in Greene County until the annual renewal period. 3. What are dog licensing fees used for?

The base fee for a dog license is $20 annually. During the dog license renewal period from December 1 to January 31, 3-year licenses ($60) or permanent licenses ($200) are available for purchase.

5. When do I need to purchase a dog license?

Dog licenses must be renewed annually between December 1st and January 31st in order to avoid a penalty. Dogs acquired throughout the year can be licensed within 30-days of ownership. Licenses can be purchased for 1-year, 3-years, or the life of the dog during the renewal period.

6. How do I get a dog license?

Dog licenses can be purchased by submitting a dog license application form to the Greene County Auditor's Office or the Greene County Animal Control Office.

7. How can I avoid a late fee?

After the renewal period of December 1st to January 31st, a penalty is assessed on licenses for dogs three-months of age or older, owned for at least thirty days, and/or relocated from out-of-state for at least thirty days. The county auditor is required to charge a penalty equal to the license fee.

8. How do I replace a lost license?

A replacement tag can be requested at the cost of $5. Please send a letter with the license number, if known, so a replacement tag can be sent.

9. How can I transfer a license to a new owner?

The ownership of a current dog license can be transferred to another owner for a fee of $5. The current owner on file, or executor of the current owner's estate, must sign the transfer form. It is also advisable for the new owner to sign the form.

10. Are dog licenses valid anywhere in the state?

Dog licenses are valid anywhere in the State of Ohio until they expire. Licenses are required to be purchased in the county in which you reside.

11. If I move here from another state, is that state's license valid?

No. You are required to purchase a license immediately upon arrival. If you wait more than thirty days, the county auditor is required to charge a penalty equal to the license fee.

1. How can I get a private autopsy?

If the death was not deemed a coroner’s case, you may have a private autopsy performed at your expense. Wright State University Boonshoft School of Medicine and The Ohio State University Medical Center perform a private autopsy. Costs range from $1,800 - $2,900*, but does not include transportation to their facility.

2. Why is a body brought to the coroner’s office?

The remains of the deceased are brought to the coroner’s office because Ohio Law requires that the coroner investigate the death of a person who has died from criminal violence, by accident, suicide, suddenly, when unattended by a physician for a long period of time or in any unusual
manner. A body may also be brought to the coroner’s office because the identity of the deceased or the next of kin may be unknown.

3. Does the coroner need permission from the next of kin for an autopsy?

Ohio Law (ORC 2108.52) provides that the coroner does not need permission for an autopsy. The coroner will make every attempt to comply with the wishes of the next of kin as long as it does not conflict with the duties of the coroner by Ohio law.

4. Will I be able to have an open casket viewing after an autopsy?

Depending on the circumstances surrounding the death, an open casket may be possible. The autopsy staff are very professional and make every effort to make this happen. However, there are times when an open casket is just not possible.

5. How long before my loved one is released and I get results?

After the autopsy is complete, the body will be released to the funeral home that the family has chosen. Depending on what time of day the death occurred, the autopsy may occur the same or next day. The autopsy results may take six to ten weeks to come back depending on the extent of the toxicology report, if one was necessary. The autopsy results come to the coroner’s office. In Greene County, one copy of the autopsy report is provided to each family. Additional copies may be purchased for a minimal cost.

6. Where is the body taken for the autopsy?

Your loved ones body is taken to the Montgomery County Coroner’s Office in Dayton, Ohio. After the autopsy is complete, the body may be released to the funeral home of your choice. Any clothing and jewelry will be transported with them to the funeral home. Other belongings may be taken as evidence by the coroner’s office. Those items may later be released to the family unless they are needed as evidence. In cases where there may be a large amount of cash or valuables, the family may need to pick that up from the probate court in their county.

7. Where can I get a copy of a death certificate?

A Pending Death certificate will be issued a few days after the death has occurred. Most insurance companies will not accept this until the “second” or Supplemental Death certificate is issued. This is completed after the results of the autopsy are received and the Coroner has ruled on the case. The death certificate is filed with the local county health department. Most funeral homes provide the family with a few copies of the death certificate. Additional copies may be purchased through the Greene County Public Health Department, Office of Vital Statistics, 360 Wilson Drive, Xenia, Ohio 45385, or by telephone at (937) 374-5639.

8. What is the cost for an Autopsy?

There is no cost to the family for an autopsy that has been ordered by the county coroner.

9. How do I choose a funeral home?

The funeral homes is selected by the family for a variety of reasons. In cases where there is no money for burial, the deceased individual may qualify for an indigent burial through decease’s city of residence; not all cities have indigent burial programs. Otherwise, families may choose to have their loved one cremated for a lesser cost to them.

10. How a death is reported?

Normally, a death is reported by hospital staff, nursing facility personnel or a local paramedic, police, or fire professional on the scene. The information needed includes the following:

• Age and date of birth

• Place and manner of occurrence

The Ohio statute does not require a party to pay a deposit when filing for a CPO.

3. What can I do if I want to dismiss my Civil Protection Order(CPO)?

If you are the Petitioner and the full hearing has not yet been held, you must appear at the scheduled full hearing to make an oral request to have the CPO dismissed.

If the full hearing has already been held and a permanent CPO has been issued, you must file a Motion to Dismiss. You may file a Motion to Dismiss by contacting the attorney of your choice or you may file pro-se. Contact the Domestic Violence Coordinator at (937) 562-6236 for further details.

1. What types of cases are handled by the Domestic Relations Court?

The Domestic Relations Court has jurisdiction over ending marriages through divorce, dissolution, legal separation, or annulment. The Court has the authority to enforce its Orders even after the marriage ends.

The Court sends out notices for hearings by regular mail. If you are unsure of your hearing date, you may contact the Court's Assignment Office at (937) 562-6245. You may also look up your court date by visiting the Greene County Clerk of Courts website, and using the CourtView program to search for your case.

5. I can’t come to court on the assigned hearing date. How do I get a new date?

You can ask the Court for a continuance by filing a Motion for Continuance. In your Motion, you must explain to the Court why you have good cause for not attending on the assigned date. Visit the Forms page for a Motion template.

Be aware that filing the Motion for Continuance does not guarantee your court date will be moved. It is your responsibility to follow-up with the Court to see if the motion was granted.

If your motion is granted, you will be mailed a new hearing date. If your motion is denied, the hearing will go forward as scheduled, even if you are not there.
Your Motion must be filed and served on the appropriate parties at least 7 days prior to your hearing.

6. Can I file my own court papers? If so, how?

7. Why can’t I talk to the Judge or Magistrate?

To ensure fairness and equal treatment, Judges and Magistrates are not permitted by their ethical rules to receive what are called ex parte communications—meaning visits, phone calls, or other forms of communication from just one side of a case.

8. What should I do if I moved or plan to move?

Review your paperwork and make sure you comply with any provisions that specifically address situations where a party plans to move.

You must also file either a Notice of Intent to Relocate or Notice of Current Address with the Greene County Clerk of Courts. Once you choose and complete the appropriate Notice, you must serve the other party with a copy. Visit the Forms page to access both Notices.

9. What is mediation?

Mediation is a confidential process in which both parties meet with a neutral, trained professional mediator. The parties and the mediator work together to reach agreements on the issues in their case. The mediator helps parties communicate and resolve issues about property, support, custody, parenting time, etc.

Mediation is confidential, meaning that nothing that is discussed in the mediation meeting can be testified to in court, and the mediator cannot be called as a witness.

If parties reach an agreement, the mediator writes out a Memorandum of Understanding (MOU) detailing the terms of the agreement. That MOU is then submitted to the court or to the attorneys for the parties. The parties also receive a copy.

10. What is service and why is it important?

Service is the process of informing a person that a legal action has been brought against them. Service is the delivery of the Plaintiff’s initial pleadings to the Defendant. The pleadings are the official documents that open a new court case. Service is also required when an old case is being reopened. The party reopening the case has an obligation to serve the opposing party.
As the Plaintiff in a case, you have an obligation to serve the Defendant in accordance with the Ohio Rules of Civil Procedure, specifically Rule 4. As the Defendant, you have the right to be served in accordance with the Civil Rules.
If the Court finds that service was not perfected (meaning service was not done in accordance with the Civil Rules), the case cannot be heard. The Court will require the Plaintiff to continue trying to serve the Defendant until the Court finds service was perfected.
Service is done by the Clerk of Courts. A set of Instructions must be filed with the Plaintiff’s initial paperwork detailing the name and address of the Defendant, as well as the chosen method of service. The Clerk of Courts will then serve the Defendant according to the Instructions.
The three most common methods of service are Certified Mail, Personal Service, and Regular Mail. Certified Mail is the most common method because a return with the recipient’s signature comes back to the Clerk of Courts, and gets filed in the case. The return tells the Court who signed for the mail, making it easier for the Court to determine whether service has been perfected. The cost for Certified Mail is added to the court costs in the case, which must be paid after the case is closed.
Personal Service is service done by sheriff who hand-delivers the pleadings to the Defendant. This method also makes it easier for the Court to determine whether service has been perfected because a return is provided and filed. Personal Service carries an additional $50 fee, which must be paid at the time of filing.
Regular Mail service is another option. Regular Mail service is sent like any other mail, and is delivered by the postal service. Initial paperwork opening a new case or reopening an old case cannot be served by Regular Mail. This method provides no return for the Court to verify service has been perfected, and returned mail can take up to 8 weeks to receive. Regular mail service is available after a case has already been opened or reopened. Motions and other documents can be served on the parties or parties’ attorneys via regular mail in an ongoing case. There is no additional charge up-front for Regular Mail service.

11. Do I need an attorney?

Yes. With the availability of quick answers on the Internet and websites peddling legal documents and advice, many people think they will save time and money by not hiring an attorney. However, it is always in your best interest to hire an attorney when you are involved in a legal matter.

Saving money by not hiring a lawyer now may cost you more than money later on.
If you choose to proceed pro se, you will be held to the same rules of law and standards of conduct as an attorney. The Court does not bend the rules for pro se litigants.

It is your right to represent yourself, however you should not do so without considering the potential consequences.

12. Who should I contact for a referral to an attorney?

13. What if I can't afford an attorney?

Many people assume they cannot afford an attorney, but have never researched the actual cost of representation. You will likely find an attorney who either offers unbundled legal services or is willing to work out a payment plan. Contact the Greene County Bar Association or Dayton Bar Association for a referral to an attorney.

You may also seek assistance from Legal Aid of Western Ohio. Legal Aid accepts a limited number of clients, and you must meet their qualifications before they will accept your case. Contact Legal Aid at (937) 228-8088.

Contact Greene County Children Services at (937) 562-6600 and/ or the police. These agencies have the ability to respond immediately to danger or threats of danger to your child.

2. The other parent is wrongfully withholding the children. What can I do?

If you are in Greene County, you may contact the Sheriff's Office. You will need to show the Sheriff's Office a certified copy of your divorce or dissolution decree, which states you are the residential parent and legal custodian of the child. The Sheriff can then accompany you to the other parent's home while you secure the return of your child. If this does not work, you should contact an attorney.

All parents of minor children who file for divorce, dissolution, or legal separation must complete the online 2-hour Co-Parenting/Divorce Class offered through the Online Parenting Programs website. 1. Can I represent myself?

The majority of court patrons are more satisfied with their court experience and results if they hire an attorney. However, you can represent yourself. If you choose to act as your own attorney you will be held to the same rules of law and standards of conduct as an attorney.

These forms are used at your own risk. The Compliance Department evaluates the use of these forms on a case by case basis. If the forms do not substantially comply with the requirements of the Ohio Revised Code and the Court's Local Rules, the forms will not be approved for filing.

5. What is the difference between a Divorce and a Dissolution?

The key difference between a divorce and dissolution is that a divorce may be granted even if one party refuses to cooperate or participate in the proceedings.

Divorce is appropriate for parties who cannot reach an agreement regarding issues of custody, support, property, etc., or have not been in contact for a long period of time. This means that only the filing party (and a witness for the filing party) must be present at the final divorce hearing. As long as the other party was served according to the Ohio Rules of Civil Procedure, the other party does not need to appear at the final hearing in order for the divorce to be granted.

A dissolution is appropriate for parties who are working together to end their marriage and are in agreement on all issues. Both parties are required to sign the dissolution documents, which means each party must actively participate in the process. Both parties must appear at the final hearing or the Court may dismiss the case.

6. What is compliance?

The Compliance Department reviews all pro se paperwork submitted for filing to ensure it complies with the rules of law in Ohio, as well as the Court's Local Rules.

Approved paperwork is forwarded to the Clerk of Courts for filing. Paperwork that is not approved is returned to the pro se litigant who submitted it with a list of corrections that must be made. The cycle of review and revision can be lengthy, but will continue until all documents comply with the applicable laws and rules.

7. How long will it take for my Divorce/Dissolution to be finalized?

Part of the timeline depends on you. Your effort and speed during the compliance process will impact how quickly your paperwork is approved and filed. For some parties, paperwork is approved within a matter of days. For others, it can take several months.

A dissolution must be scheduled for a final hearing within 30 to 90 days of filing.

A timeline for divorce is harder to estimate because it is heavily dependent on the circumstances of the parties. Divorces can be finalized relatively quickly or can be extended for long periods of time. Factors such as how long service takes, whether the defendant participates in the proceedings, how many issues the Court must address, whether children are involved, etc., will impact the length of the process.

Under Ohio Supreme Court guidelines, a divorce with children must be finalized within 18 months of filing; a divorce without children must be finalized within 12 months of filing.

If you are unable to pay the filing fee due to financial hardship, you may be eligible to have the fee waived. If you would like the Judge to consider waiving your filing fee, please submit a Poverty Affidavit. The Poverty Affidavit should be completed in its entirety and submitted with your other paperwork for review by the Compliance Department.

Once your paperwork is approved by the Compliance Department, your Poverty Affidavit will be sent to the Judge for review. If your Affidavit is approved, you will not be required to pay the filing fee at the time of filing. You may be required to pay court costs at the conclusion of your case.

3. If we have Shared Parenting, why do I have to pay child support?

The purpose of child support in shared parenting cases is two-fold. First, child support is for the children, and is intended to reduce the impact of a great disparity in parents' incomes. Children who are accustomed to one standard of living should not, because of a divorce or dissolution, have to live in one “rich” house and one “poor” house.

Second, by assigning one parent as primarily responsible for providing for the material needs of the child, the Court hopes to reduce conflict between the parents over the children's needs.

Child support schedules are set to meet children’s expenses in proportion to their parent’s income. The court may deviate from the Child Support Guidelines if there are specific facts which justify a deviation.

4. What if I cannot afford to pay my child support obligation?

You must contact the Child Support Enforcement Agency (CSEA), (937) 562-6200 to alert them to the situation. They may be able to assist you by conducting an Administrative Review.

If you are ineligible for CSEA assistance and you are unable to afford your child support due to a change of circumstances, such as an illness or losing your job, you may consider filing a Motion with the Court.

1. What is CASA?

CASA stands for Court Appointed Special Advocate (CASA), sometimes referred to as a Guardian ad Litem (GAL). These people are trained community volunteers appointed by a judge to advocate for the best interests of an abused, neglected, or dependent child in court.

A CASA/GAL provides a judge with a carefully researched background of the child to help the court make a sound decision about the child's future.

The CASA/GAL makes a recommendation on placement and services and, most importantly, monitors the case until it is resolved.

2. Can anyone be a CASA?

CASA/GALs are ordinary citizens. No special or legal background is required; however, volunteers are screened closely for objectivity, competence and commitment.

5. How are the juveniles prepared for their futures?

The big takeaways from the program tend to be better social skills, more self-control, an increased sense of responsibility, more self-respect and respect for others, more empathy and family re-unification.

6. What do you do to provide opportunities for the MVJRC youth?

Our focus is on changing thinking, which changes behavior, which changes outcomes (cognitive-behavioral therapy). Most opportunities would come after the rehabilitation work is done and the youth are released. We do provide information, do community service, take field trips, etc.

7. What is your solution to the negative influences these juveniles may have once they return to their lives (e.g., family, friends, acquaintances, groups they are involved in)?

The MVJRC correctional-treatment program is funded by the Ohio Department of Youth Services pursuant to a grant. That grant stipulates that once a youth is released from the MVJRC program, no form of after-care is provided. Although we do a lot of after-care planning, the actual role of after-care is that of the juvenile court (all youth committed to MVJRC are committed by a juvenile court judge on a felony offense). The Ohio Department of Youth Services also funds juvenile court programs and promotes after-care programs through a very successful funding model called RECLAIM.

So, we are just focused on rehabilitation and the court is responsible for after-care. That being said, there are a lot of gaps in the juvenile system regarding effective after-care. It is an area of corrections that needs a lot of work.

8. What kind of interaction do the juveniles get to have with their peers and how do you promote positive social interactions and social skills?

We work with boys and girls ages 12-18. The average length of stay is about 160 days. We are a secure, residential facility with a maximum capacity of 24. Our average daily population is about 21. The youth live in 4 units based on “risk-level” and other factors. We engaged in a “Conditions of Confinement” Action Plan from 2012-2014 to minimize confinement time in their individual sleeping rooms, so the youth are often interacting in structured activities or recreational activities on their living units or in other areas of the facility. Part of our curriculum is called Skillstreaming, which is an evidence-based, structured social skills training curriculum that includes role-playing strategies for dealing with difficult situations. A secondary benefit of the role-playing is an increased level of comfort speaking in front of people and interacting socially.

The opposite sex are kept separate, except for special events.

4. Do I have to have a home study done?

Yes. Home studies are required on all adoptions, with the exception of Adult Adoptions and Foreign Adoptions. Foreign Adoptions that have been completed in another country do not require a home study to be recognized and have an Ohio Birth Certificate prepared.

5. What does a home study involve?

All adoptions must have a home study completed per Ohio law, with the exception of Adult Adoptions and Foreign Adoptions. If you are not going through an agency the Court will appoint an Adoption Assessor. The Adoption Assessor will send you a packed by mail once the Court has accepted your filings. 

The packet includes:

1. A letter from the assessor with their contact information
2. A checklist of all documents that you must gather and/or complete
3. Specific forms that the Court requires to be completed

Your packet must be completed prior to the assessor visiting your home. Everyone who lives in the home MUST be present for the home visit with the assessor.

6. How can I obtain medical information from an adoption file?

If you would like to have us review your file to determine if there is medical history, you must send the following to: Greene County Probate Court, 45 N. Detroit Street, Xenia, Ohio 45385.

• A letter to the Judge explaining why you want this information. In the letter, you must provide us with your name, address and telephone number.
• $50.00 fee: This fee must be included with the letter (cash, check or money-order only) 
  • Note: the fee is non-refundable. If there is no medical history in the file, you do not get the filing fee back.

We do not keep adoption files on site. Therefore, it may take several business days for us to obtain the file. When we have the file on site, the Judge will review the entire file and determine if there is anything in there that we are allowed by law to release to you.

If there is not medical information in the file:
The Judge will send you a letter explaining that there is no medical information in the file and there is nothing that we are allowed by law to release to you. The matter will then be closed

If there is medical information in the file:
We will contact you to schedule an appointment for you to meet with the Judge.

At the meeting you will need to provide verification as to why you need this medical information. The Judge will then make a determination as to what information may be released to you.

Greene County Probate Court does not keep filing fees on deposit. Actions are charged on a “pay as you file” basis. Initial filing fees are paid to initiate the action. Subsequent filings are charged at the time of filing. It is important to check our Filing Fee Schedule before filing with the Court.

2. Does your Court charge per page for filings?

Greene County Probate Court does not charge per page on most regular actions. The only per page filing fees are applicable to certified, authenticated and exemplified copies.

Greene County Probate Court accepts cash, check, money order, credit or debit cards and online payments. Personal checks are only accepted from within the State of Ohio. 4. Are certified copies included in my filing fees?

Certified Letters of Authority, Letters of Guardianship, and certified Entries are now included with the initial filing fees on all actions. 5. Do you charge for service costs before service is issued?

Service fees for FedEx, USPS Certified Mail or Sheriff service are collected after service is issued. Greene County Probate Court will notify counsel and parties of service fees as they become due.

6. When does your Court issue refunds?

Issuance of refunds are rare based upon the Court’s “pay as you file” system. The only routine issuance of refunds applies in cases in which a service is unable to be performed, such as a guardianship investigation or an adoption assessment.

7. Do you charge different filing fees for appointment of a successor fiduciary or successor guardian?

1. How much does a marriage license cost?

Effective January 1, 2020, the fee for a marriage license is $70.00. You may pay this fee in cash, credit card, debit card, cashier's check, money order or by check drawn on a local bank made payable to Greene County Probate Court.

We will not issue a Certified Copy of Marriage Record until your check has cleared and payment is confirmed. If the check is dishonored for any reason, there will also be a $50.00 returned check charge and a $25.00 administrative fee.

2. How do I get a certified copy of my marriage record?

For Marriages After October 17, 1991, you can chose one of the following options:

• The full names of both applicants at the time the marriage license was issued.
• How many certified copies you need.

• Self-addressed, stamped return envelope for us to use in sending the documents to you.

3. How long will it take to get our marriage license?

Approximately 15 to 20 minutes.

4. Is there a waiting period, or can we get married the same day?

After the application is accepted, there is no waiting period in Greene County to receive the license. You may receive your license and be married on the same day.
Greene County Probate Court does not perform marriage ceremonies.

5. How long is my marriage license valid?

The marriage license is valid for 60 days.

6. Do both parties have to be here together?

Yes, both applicants must appear together.

7. Must I show proof of divorce, dissolution or annulment?

If either applicant has been married before, they must bring all prior divorce, dissolution or annulment information and a certified copy of the final decree of their last divorce, dissolution or annulment. If the decree is in a foreign language, it must be translated in writing.

8. Do I need to make an appointment?

Yes, we no longer accept walk-ins. You must start the application process online, please see the Begin the Application Process Online link on the Marriage License page. Once you have completed the online application it will ask you to schedule an appointment. You may not schedule appointments by phone.

9. Who may solemnize a marriage?

Only a duly ordained minister who is registered with the Secretary of the State of Ohio, a Judge, a Mayor, or the Superintendent of the State School for the Deaf may solemnize a marriage.
Greene County Probate Court does not perform marriage ceremonies.

10. How do I obtain proof of my "Common Law Marriage"?

Common law marriage was no longer recognized in the state of Ohio after October 10, 1991. The Probate Court has nothing to do with Common Law Marriage. If you need to provide verification of a Common Law Marriage that took place in Ohio, you need to contact the Social Security Administration in your area.

11. Are you open on Saturdays?

No, the courthouse is closed on weekends, all legal holidays, and the day following Thanksgiving.

12. Do we need blood tests?

No blood tests or physical examinations are required in the state of Ohio.

The County Prosecutor handles adult felony charges and all juvenile cases; for misdemeanor charges, please contact Xenia Municipal Court or Fairborn Municipal Court. For juvenile cases, please contact our juvenile division.

3. How do I file criminal charges against an individual?

If you are the victim of a crime or believe a crime has occurred, please contact your local police agency. The police will investigate and present the case to the Prosecutor’s Office for review. Please note that you cannot drop charges; only the assistant prosecuting attorney, with the judge’s permission, can dismiss criminal charges.

4. What happens if I am subpoenaed to testify in a legal matter?

If you received a subpoena, you are required by law to appear as instructed. A subpoena is an order by a Court requiring you to appear for a scheduled court date. If you refuse to appear, the Court does have the authority to issue an order for your arrest. If you have been subpoenaed to testify in a trial for felony charges and have questions, the Greene County Prosecutor’s office will be happy to assist you. Please have your subpoena in hand and call (937) 562-5250 for assistance. 

5. Will the case be continued if I am not there?

If you are subpoenaed to court as a victim or witness and you do not appear, the judge assigned to the case may not permit a continuance and the case will be dismissed. If you are the defendant and you fail to appear in court, a warrant will be issued for your arrest.

If you are indicted on a felony offense in the Greene County Court of Common Pleas, you must come to the Public Defender’s Office and apply in person. If you are determined to be indigent (poor), an attorney will be assigned.

3. What if I am in jail?

You can request an application form to fill out while you are at the jail. If you get released from
jail, you must come into our office right away.

4. What if I am able to hire my own attorney?

If you are financially able to hire your own attorney, you are encouraged to do so immediately.
Our program is a poverty program for people with household income that is determined to be
eligible.

5. What can I do to help my lawyer help me?

If you are aware of witnesses who have information that might help your defense, provide the
names, addresses and telephone numbers of such persons to your lawyer as soon as possible. It
would also be helpful for you to get written statements from these witnesses.

1. I paid off my mortgage but have not received the deed. Why?

In most instances, you received the Deed when you purchased the property, and financed the purchase with a lending institution. The previous owner signed the deed transferring title to you, and a copy of that deed was filed in the Recorder’s Office. The deed does not change, even if you have mortgage. The lender placed a lien (Mortgage) on your property. When this lien (Mortgage) is paid in full, the lending institution will release the lien (Mortgage). To release the lien (Mortgage), your finance company sends the Recorder’s Office a release/satisfaction of mortgage document, stating that your mortgage has been paid in full. By law, your lending institution has ninety (90) days to file this document from the date you paid you loan in full. Yes. Under the new law, exhibits and attachments—previously recorded and newly created—must comply with the new formatting requirements. For example, if you attach a copy of a previously recorded mortgage to a newly prepared mortgage subordination, you will need to reformat the attachment to comply with the new law.

Certified death certificates are exempt from the documents standards law. You will not be charged a non-conforming fee if you attach a certified death certificate as an exhibit.

5. If my document does not meet the formatting requirements, will you still record it?

That depends. There is a $20.00 fee—in addition to recording fees—for every document that does not conform to the new format requirements. We will record your non-conforming document only if you include the $20.00 per document and specifically request the recording. If you do not include the fee, we will not record the document.

6. Can I highlight signature areas on the document to make it clearer where parties need to sign?

No. Highlighting is not permitted under the new document standards.

7. Will I be charged the $20.00 non-conforming fee if I record a certified copy from another county?

That depends. The new law does not apply to documents executed prior to July 1, 2009. If the document was executed by the parties prior to July 1, 2009, you will not be charged the fee. On the other hand, if a non-conforming document is executed and filed after July 1, 2009 and you want to record a certified copy of that document in another county, you will be charged the $20.00 fee.

8. Will I be charged the $20.00 non-conforming fee if I re-record a document?

Again, that depends. The new law does not apply to documents executed prior to July 1, 2009. If the document was executed by the parties prior to July 1, 2009, you will not be charged the fee. On the other hand, if a non-conforming document is executed and filed after July 1, 2009 and you want to re-record a document, you will be charged the $20.00 fee.

9. Do documents that are prepared and executed out of state still have to comply with the document standards law?

Yes. Documents recorded in Ohio must comply with Ohio law. The place of preparation and/or execution of a document is not a factor.

10. Will I be charged the non-conforming fee if I release a mortgage or a lien by using the originally recorded document?

Yes. If you are releasing a mortgage, lien (home owner, condo owner, mechanics, etc), a land contract, etc. By using the originally filed document, you will be charged the $20.00 fee if the document does not conform to the new standards. For instance, if you filed a mortgage in 2008, and you write, type, or sign a release statement directly on the original recorded mortgage and submit it for recording as a release today, we use the release date to determine whether it falls under the new law. The same applies to liens. Remember, you always have the option of releasing by a separate instrument.

1. What information should I be aware of regarding the construction of a new house?
